Bhuyayi Sithole (30) of Village 6, Daisyhill, Chief Mutema’s area of Chipinge had pleaded not guilty to rape charges when he appeared before Mutare regional magistrate, Mr Livingstone Chipadza last week, but was however convicted after a full trial.
Three years of his sentence were suspended by Mr Chipadza, leaving him to effectively serve a 12-year jail term.
Mrs Christine Nyamaropa who appeared for the State told the court that Sithole was armed with a knife when he raped the juvenile and the fear of the knife pointed at her made her comply with what the accused was ordering her to do.
"On August 22, 2009 at around 7pm, the accused approached the complainant who was going to the toilet at their homestead.
“Sithole who was armed with a knife ordered the complainant to follow him.
“Due to fear, the complainant followed and they walked for about 500m from the complainant’s homestead. The accused forced the complainant to lie on her back and raped her once.
"The complainant later advised her aunt the following day and the case was reported to the police leading to Sithole’s arrest," said Mrs Nyamaropa.
